Claiming Kids for Tax Purposes....Need Answers!!!

This will be the first year I will be filing single after my divorce in 2007.  My ex and I have two children (5 and 3).  My question is about deducting the children for tax purposes.  I suggested we each claim one child to be fair.  Does anyone know if it can be that simple....he just claims one kid and I claim the other?  One concern was does it matter if the children's primary residence for school, formal matters is my address, yet we do split the kid custody 50/50...meaning they spend half of their physical time with each of us?  If anyone can provide insight into claiming kids on your taxes after divorce it would be most helpful.  What did you do, what legally can you do or not do?  Thanks.....

ok, well you can add an addendum.  and ps: take the younger child.....and be sure to add in the addendum that if one of you stops working during the year, the other gets to claim both kids.....of if support stops coming, you get to claim both kids, etc.

Thanks Paula...unfortunately we completely left this out in decree.  I am beginning to realize our attorney did not do much beyond what we did on our own.  Anyway the good thing is that my ex and I are completely amicable so we are working things out now so it will be fine.  I will check out your link as well.  Thanks....

that should be detailed in your divorce decree. and yes, in your situation, typically each parent takes one kid.  there is actually a form you both must fill out and give to the other every year when you do this.  don't forget that.  you have to ask for it.

but i would double check your divorce decree too.  if it's not stated there, you need to get that added in.
