Need some tax advice, PLEASE!

My boyfriend is legally married. He filed his taxes this year when they were together, filing jointly. He ended up leaving and she kept the income taxes. Not only did she keep the income taxes, she also got the stimulus check that came out. I just want to know can she do that? Is there anything he can do? If they are separated and she keeps the checks, is that fraud? If someone knows, please let me know. Thanks

tell him to get divorced and have it brought up in discovery. Since they are still legally married with no separation agreement she didn't do anything wrong per se - it is her money just as much as his.

 

He may not get any of it back since he is spending marital assets on you - his lover - which is something she is entitled to be reimbursed for - every penny he spends on you he is stealing from his wife.

Filed jointly it should have both names on the check. But my husband never signed anything while we were married. I signed his name to everything but the tax refund because he was away most of the time.
Tell  him to ask her about the refund and tell the wife he is going to turn it over to the IRS to see what happened to their refund. If she doesn't know better that might get  him his half.

yes if they are seperated w/o a seperation agreement - its grab what you can - which is why I tell people to get one....
I wonder if the check ismade out to both parties ? Mr tom jonesand ms Beth jones? if she forged his name you could go after her for that.  Id chck with the IRS to see how they come and the bank - if she put it in a joint account they willjhave a copy???

first, why are you with a married man?  second, if they have started the legal paperwork, there will be stipulations about the taxes in the forms.  if they have yet to start the paperwork, it's the wild west.  meaning, they can both do whatever.  paperwork needs to start.
